Sexual Abuse Statute of Limitations in Georgia

In Georgia, the filing deadlines for sexual abuse cases depend on the survivor’s age when the abuse occurred. Adults typically have two years to file from when the abuse occurred. Survivors of childhood abuse that happened before July 1, 2015, have until their 23rd birthday to file suit. For abuse that occurs after that date, survivors have until they turn 23 or within two years of when they “knew or had reason to know the abuse resulted in injury.”

Certain circumstances, such as fraud, intimidation, or delayed discovery of harm, can cause these deadlines to be paused or extended. Because these laws are complex, consulting a Georgia sexual abuse attorney can guide you through the process and determine what deadline applies to your case.

Read our Georgia statute of limitations guide for more details.

Civil vs. Criminal Sexual Abuse Cases

Criminal and civil sexual abuse cases differ primarily in who brings the case and the possible outcomes. Prosecutors file criminal charges on behalf of the government and seek criminal penalties against the abuser, like jail time. Meanwhile, abuse survivors file civil lawsuits against abusers and the institutions that enabled the abuse, seeking compensation for their damages or other relief.

Whether charges are filed has no bearing on whether a survivor can pursue a lawsuit. The criminal process primarily focuses on punishing the abuser, and not on making the survivor whole. A civil case, on the other hand, allows the survivor to have a voice and pursue the compensation they need for the treatment and support they need to heal.

At Andreozzi + Foote, our Atlanta sexual abuse attorneys focus on holding institutions accountable for their negligence and for enabling sexual predators to commit crimes against others.

Damages and Compensation Available for Sexual Abuse Victims

Civil lawsuits provide a way for survivors to seek compensation and hold abusers and the institutions that enabled abuse accountable. Survivors may seek compensation for various financial damages, including:

  • Medical and therapy expenses: Past and future costs for counseling, psychiatric care, medication, and recovery programs
  • Lost educational and career opportunities: The effects of the abuse on the victim’s educational and career goals
  • Other costs: Relocation, school changes, long-term support, and other disruptions linked to the abuse
  • Emotional distress, pain, and suffering: Covers the physical, emotional, and psychological trauma, including PTSD, anxiety, depression, and loss of enjoyment of life

In some cases, courts may award punitive damages to hold institutions accountable for egregious misconduct and deter future abuse.

The amount of compensation can vary depending on factors such as the severity and duration of the abuse, the survivor’s age at the time, and how it has affected their daily life.

What To Expect in the Legal Process After Sexual Abuse

Because every case is unique, the legal process can look different for each survivor. For instance, cases involving past abuse may require different strategies than those of more recent incidents.
