On September 24, 2025, Milpitas Police arrested pulmonologist Dr. Sanjay Kumar Agarwal, 68, for the alleged sexual abuse of a patient.
According to a police press release, on September 16, 2025, authorities received a complaint alleging that Dr. Agarwal had made prior inappropriate contact with a female patient.

The San Jose resident was arrested at his Milpitas office, and then, according to police, “booked into the Santa Clara County Main Jail for sexual battery.”
Update – December 2025
In December 2025, NBC Bay Area announced that, according to Milpitas Police, two additional individuals had come forward with sexual misconduct allegations against Dr. Agarwal. Both individuals reported that Dr. Agarwal touched them inappropriately while they were employees at Regional Medical Center in San Jose, where he also worked.
Police said the alleged incidents occurred years earlier, in 2011 and between 2014 and 2015, but the individuals decided to come forward after seeing coverage of Dr. Agarwal’s arrest in September. Complaints had not been filed at the time of the incidents. Milpitas Police Officer Michelle Sanchez noted that while the statute of limitations has expired for those allegations, the information has been forwarded to the District Attorney’s Office as part of the broader investigation.
As of December 22, 2025, a fifth woman came forward alleging inappropriate touching by Agarwal. Police say the alleged incident occurred in 2023 during a medical consultation at his practice. The woman recently reported the incident after learning of similar allegations reported by NBC Bay Area’s Investigative Unit.
Court Records Reveal Separate Criminal Case
Court records reviewed by NBC Bay Area revealed that Dr. Agarwal is currently facing a separate, active criminal case involving a woman who applied to work for him at his Milpitas office.
According to a police report, the woman said she was interviewing and shadowing Dr. Agarwal for a medical assistant position when he “‘allegedly got close to her and touched her breast with his chest in his office. She said he kissed her forehead before asking ‘…how she would feel about having sex with him for money.’ Dr. Agarwal allegedly told her ‘…if she did not want to get paid for sex with him, he would still hire her.’” (NBC)
The woman said that she declined his offer. Dr. Agarwal has pleaded not guilty in the case to both misdemeanor sexual battery and soliciting prostitution. NBC reports that the case is ongoing.
Despite the multiple allegations now under investigation, NBC reports that Dr. Agarwal continues to operate his private practice in Milpitas. His medical record is still active in California.

Dr. Agarwal Denies the Allegations
When contacted by NBC Bay Area’s Investigative Unit, Dr. Agarwal denied the allegations, stating, “‘This is bogus. This is fraud, and I won’t be speaking about this any further. My attorneys are addressing it.’” His attorney had no comment.
Dr. Agarwal’s Background and Affiliations
Dr. Agarwal operates the Comprehensive Sleep Center in Milpitas, CA, and identifies himself as the CEO of California Specialty Physicians, a multispecialty practice. He markets the Comprehensive Sleep Center as a respected and safe facility offering sleep diagnostics and treatment for a wide range of sleep disorders and respiratory diseases.
On the home page of his practice Dr. Agarwal lists his affiliations to several hospitals: Regional Medical Center and Good Samaritan Hospital (both part of the Good Samaritan Health System), El Camino Hospital, and O’Connor Hospital. His Doximity profile also lists his affiliation with Highland Hospital.
On his Good Samaritan Hospital profile, Dr. Agarwal states, “Patient care with compassion is number one.” He promotes a commitment to ethics and social responsibility and claims to provide empathetic professional care.
The irony is unmistakable: a doctor who marketed himself as compassionate and ethical now stands accused of sexually abusing multiple individuals. It is also deeply tragic, as the allegations suggest he violated the trust not only of a patient, but also of others who encountered him in professional settings. In medical environments, it is reasonable to expect safety and professionalism from doctors, not exploitation.
Hospitals’ Responses
“After learning about his September arrest, Santa Clara County health officials – who oversee Regional Medical Center – said he is no longer able to treat patients at their facilities.” (NBC)
An El Camino Health spokesperson confirmed that Dr. Agarwal does not have privileges at El Camino Health, nor does he have an active contract with the health system.
Although Agarwal is not an employee of Good Samaritan Hospital, he previously maintained an active affiliation with the facility. A hospital spokesperson emphasized that he was not a hospital employee and that the alleged incidents did not occur at the hospital.
According to NBC, on December 19, “HCA Healthcare, which owns Good Samaritan Hospital in San Jose, told the Investigative Unit they suspended Dr. Agarwal and he’s no longer allowed to treat patients at the facility. The action comes after HCA Healthcare learned about the additional alleged victims.”
Hospitals May Be Held Liable
Although Dr. Agarwal’s September arrest involved conduct at his private office, subsequent reporting has raised concerns about his conduct in hospital settings, prompting questions about whether warning signs were missed or ignored. Removing a physician after reports of abuse surface does not excuse earlier failures or eliminate institutional responsibility.
Hospitals have a duty to maintain effective vetting, credentialing, supervision, and reporting protocols for the physicians they allow to practice. When complaints are not properly documented, investigated, or escalated, or when reporting systems are inadequate, hospitals may be held accountable for harm that occurred before corrective action was taken. Failure to act on warning signs can result in civil liability for a hospital that failed to protect patients and employees.
