What Are The Different Types Of Sexual Abuse?
There are several different types of sexual abuse under New Jersey law, including the following:
- Sexual abuse: Any act of sexual contact between a child and an adult.
- Sexual assault: Any act of sexual contact that one party did not consent to.
- Sexual contact: Any intentional touching of the victim’s intimate parts for the perpetrator’s sexual arousal or gratification.
- Sexual violence: Any sexual act perpetrated against someone’s will, including rape, unwanted touching, sexual harassment, and threats.
Civil vs. Criminal Cases
There are several options for pursuing justice for sexual abuse survivors in New Jersey: pressing charges through the criminal justice system, filing a civil sexual abuse lawsuit, or both. In a criminal case, the perpetrator would face jail time and other penalties to punish them for their actions. On the other hand, civil cases aim to financially compensate the survivor for the harm they’ve suffered.

What Compensation Can I Receive for A New Jersey Sexual Abuse Claim?
In a civil sexual abuse case, victims may be able to recover multiple types of damages depending on the circumstances of their case, including economic and non-economic damages. In some cases, you might also be eligible to recover punitive damages. Economic damages compensate victims for quantifiable financial losses caused by their abuse, such as medical bills, lost wages, and therapy costs. Non-economic damages aim to compensate victims for non-quantifiable emotional losses resulting from abuse, such as PTSD, pain, suffering, and emotional distress.
In a civil case, the court may award punitive damages to punish the perpetrator for their wrongdoing and deter similar misconduct in the future.
What Is The New Jersey’s Statute of Limitations For Sexual Abuse?
You might only have a limited time to pursue justice for sexual abuse in New Jersey. The deadline depends on the type of sexual abuse case you are pursuing in New Jersey. In criminal cases, New Jersey eliminated the criminal statute of limitations for sexual assault in 1996, meaning there is no time limit for reporting your abuse to the police. Prosecutor can bring criminal sexual assault charges at any time, regardless of how long ago the abuse occurred.
However, civil sexual abuse cases are different—there are deadlines for filing lawsuits in New Jersey. Survivors of childhood sexual abuse or assault have until their 55th birthday to file suit, or seven years from their discovery of the damage the abuse caused, whichever is later. Survivors of sexual abuse who were adults when the abuse occurred have seven years from the date of the offense or discovery of damages to file a civil lawsuit.
What Should I Do If I Was Sexually Abuse or Assaulted in New Jersey?
If you have been sexually abused or assaulted in New Jersey, take these steps immediately to protect yourself and your legal rights.
- Get to a safe place away from the abuser if possible.
- Do not shower, change your clothes, eat, drink, or do anything that may destroy evidence.
- Seek medical attention for any injuries you sustained and to check for sexually transmitted infections.
- If you wish to have forensic evidence collected, call the police.
- Contact your county’s designated sexual violence agency for information on your options, counseling, victim advocates, and more.
