In a lawsuit filed on October 2, 2024, five former students of East Troy Middle School in Wisconsin have taken legal action against former band teacher John Rash, accusing him of years of sexual abuse. The plaintiffs, identified as M.G., I.C., K.M., P.C., and E.H., seek justice against Rash but also against the East Troy Community School District and several school officials for allegedly failing to intervene despite numerous complaints.

The Allegations: A History of Abuse by John Rash Ignored

The plaintiffs assert that Rash repeatedly fondled and groped female students during private band lessons and made inappropriate sexual comments. The abuse spanning years fostered a hostile environment that left lasting emotional scars. The school district and its administrators, including the principal, school counselor, and district administrator, allegedly failed to take adequate action.

The complaint accuses school officials of turning a blind eye to Rash’s behavior, allowing him to remain in his teaching position even after investigations revealed his misconduct. These repeated failures allegedly left vulnerable students exposed to further abuse, all while school officials prioritized the institution’s reputation over student safety.

Failure to Protect: A Violation of Title IX

The lawsuit brings several legal claims against the East Troy Community School District, including violations of Title IX and the Fourteenth Amendment. Title IX requires schools to provide an environment free from sexual harassment and abuse. In this case, the plaintiffs argue that the district’s failure to take appropriate action deprived them of their right to an education free from abuse.

Veronica N. Hubbard, lead counsel for the plaintiffs, remarked, “This case represents a systemic failure by school officials to protect vulnerable students from a known predator. We are seeking accountability from the district and its administrators for allowing this abuse to continue and for putting the reputation of the institution over the safety of children.”

The District’s Negligence and John Rash’s Revoked License

Despite the mounting evidence against Rash, the East Troy Community School District allegedly continued to employ him. The Wisconsin Department of Public Instruction conducted an investigation that led to Rash surrendering his teaching license in 2021. The complaint claims that the district was notified of his revoked license but failed to take appropriate steps, such as reporting Rash’s behavior to law enforcement or informing his parents of his actions.

This alleged negligence has prompted the plaintiffs to seek justice through civil litigation. They aim to hold the district accountable for failing to protect students and address such misconduct.
