Congress Passes the Take It Down Act

Congress has officially passed the Take It Down Act, an extraordinary step forward for survivor rights and digital accountability. This bipartisan bill aims to crack down on online platforms that knowingly host or fail to remove child sexual abuse material (CSAM). It includes increasingly dangerous AI-generated content. As a survivor and advocate, I cannot overstate how monumental this legislation is for protecting the most vulnerable among us: our children.

For too long, the internet has operated as a digital Wild West. Predators and traffickers could post and share CSAM with impunity. Survivors—many of whom were abused as children and had their pain immortalized in images—have had virtually no recourse. When those images resurface online again and again, the trauma of that constant digital violation is often worse than the initial abuse. The Take It Down Act changes that.

What Does the Take It Down Act Do?

  • Targets Big Tech: Platforms that knowingly host or fail to remove CSAM swiftly can now be held legally accountable.
  • Covers AI-Generated CSAM: Recognizes that digitally fabricated images of child abuse are just as harmful and traumatizing, even if no physical abuse occurred. The law treats these synthetic images as CSAM, closing a terrifying loophole.
  • Provides New Tools for Victims: Survivors and families can now submit takedown notices through a centralized system. This drastically improves the chance of illegal content being removed quickly.
  • Enforces Penalties: Imposes stiff fines on platforms that ignore takedown requests or refuse to remove known CSAM.

This legislation follows a wave of public outrage and legal action. It includes Pennsylvania’s recent filing of its first criminal case involving AI-generated child sexual abuse material. The timing couldn’t be more critical.

What This Means for Survivors

This is a turning point for survivors of child sexual abuse, especially those whose images have been exploited online. It means their voices are finally being heard.

The government is no longer looking the other way.

And justice, long overdue, is beginning to take shape—even in the ever-evolving digital world.

Online sexual abuse is not just a threat—it’s a reality for many children and teens nationwide. This includes things like sharing explicit images without consent, grooming, and live-streamed attacks. Abusers are using more tactics online that often go unnoticed. Survivors feel alone, ashamed, and powerless as their abuse spreads online. For many, the trauma from online abuse is as severe as or worse than in-person assault. This is especially true because it can occur anywhere, at any time, and often without adult supervision or awareness.

Education, prevention, and legal change are powerful allies in our quest for a safer online world. This law marks an exciting beginning, but we can achieve so much more together! Let’s inspire children to recognize online grooming, support families in navigating online safety, and demand accountability from companies that fail to act. With initiatives like the Take It Down Act and continuous legal support, we can transform the digital landscape into a haven for everyone. Together, we can uplift and empower survivors!

Survivors Deserve Civil Justice Too

While this new law strengthens criminal accountability, civil lawsuits remain one of the most powerful tools for survivors. Civil action not only empowers survivors to seek damages, but it also exposes systemic failures. It holds institutions and platforms accountable and creates meaningful change.

At Andreozzi + Foote, we represent survivors in civil lawsuits against individuals, schools, churches, and youth organizations. We are increasingly targeting digital platforms and companies that facilitate this abuse.
