For years, patients trusted Dr. Sean Michael Lynch with intimate and sensitive medical care. Now, multiple lawsuits accuse the North Carolina gynecologist of sexually inappropriate conduct during medical examinations, including allegations that he performed medically unnecessary vaginal touching, made inappropriate comments to patients, and exploited his position of trust during gynecological appointments.
Survivors deserve answers. They deserve accountability. And they do not have to face this process alone. Andreozzi + Foote represents survivors of doctor sexual abuse nationwide, focusing not only on the individual physically accused of misconduct, but also the medical institutions and health systems that may have failed to protect patients.
“When patients seek gynecological care, they are placed in an extremely vulnerable position and are entitled to feel safe, respected, and protected. Allegations that a physician exploited that trust for personal gratification are deeply disturbing. Cases like these also raise important questions about whether medical providers and health systems ignored warning signs or failed to implement safeguards designed to protect patients from abuse.”

Timeline of Allegations & Investigations Against Dr. Lynch
June 30, 2023 - Alleged Assault During Gynecological Exam
According to a lawsuit filed in Gaston County Superior Court, a woman attended a routine annual gynecological appointment at CaroMont Women’s Health – Ashley Clinic in Gastonia.
The lawsuit alleges:
- A nurse left the room after the Pap smear portion of the exam began
- Dr. Lynch remained alone with the patient for the remainder of the examination
- After removing the speculum, Lynch allegedly continued touching the patient’s vaginal area without explanation
- He allegedly inserted his fingers into the patient’s vagina and instructed her to squeeze around them
- The patient questioned why the procedure was necessary because she had never experienced similar conduct during prior exams
- According to the lawsuit, Lynch abruptly ended the exam after the patient pushed back and questioned his conduct
The lawsuit further alleges the patient later experienced symptoms consistent with a panic attack following the examination.
November 2023 - Follow-Up Appointment Concerns
According to the lawsuit:
- The patient requested a different physician for follow-up care
- Her requests were allegedly denied multiple times
- During a later appointment, Lynch allegedly made comments about her appearance that felt “out of place and strange.”
The woman later attempted to file a complaint and was reportedly informed that Lynch no longer worked at the clinic.
December 2023 - North Carolina Medical Board Reprimand
Separate from the sexual assault allegations, Dr. Lynch was reportedly reprimanded by the North Carolina Medical Board after allegations that he showed intimate photographs of unconscious patients to individuals at a bar.
Reports indicate:
- The photographs allegedly involved patients who had not consented to the images being shared
- Lynch was allowed to retain his medical license under certain conditions
- The disciplinary action raised concerns regarding professional boundaries and patient privacy
The existence of prior disciplinary concerns may become an important issue in litigation involving whether institutions knew or should have known about potential risks to patients.
November 2025 - Additional Lawsuit Filed
A separate lawsuit reportedly filed in 2025 alleges that Dr. Lynch:
- Made sexually inappropriate or lewd comments to a patient
- Directed the patient to squeeze his fingers during an examination
- Engaged in conduct allegedly intended for personal gratification rather than legitimate medical care
May 2026 - Civil Lawsuit Filed Against Lynch & CaroMont Health
In May 2026, a civil lawsuit was formally filed against Dr. Lynch and CaroMont Health entities in Gaston County Superior Court.
The lawsuit alleges:
- Sexual abuse occurred during a routine gynecological examination
- CaroMont Health failed to adequately supervise Lynch
- Institutional safeguards failed to protect patients
- Warning signs and prior concerns may have been overlooked
Dr. Lynch has not been criminally charged in connection with the allegations, and the claims remain civil allegations.
Allegations Against CaroMont Health
The lawsuits do not focus solely on Dr. Lynch individually. Plaintiffs have also accused CaroMont Health and its affiliated entities of failing to properly supervise him or protect patients, despite alleged warning signs and prior concerns about his inappropriate behavior.
Institutions that employ physicians may have legal responsibilities to:
- Maintain adequate patient safety procedures
- Ensure appropriate chaperone policies during sensitive examinations
- Investigate complaints of misconduct
- Monitor physicians with prior disciplinary concerns
- Protect patients from foreseeable harm
When healthcare systems fail to implement safeguards or respond appropriately to complaints, patients may remain at risk.
Understanding Doctor Sexual Abuse
Sexual abuse committed by physicians can be particularly traumatic because medical treatment inherently involves trust, vulnerability, and physical exposure. Many survivors initially question whether what happened was medically appropriate, especially during gynecological or pelvic examinations.
Common reactions among survivors include:
- Confusion about whether the conduct was medically necessary
- Delayed recognition of abuse
- Fear of not being believed
- Shame or embarrassment
- Anxiety surrounding future medical care
- Panic attacks or trauma symptoms following appointments
These reactions are common and do not diminish the seriousness of the harm experienced.
Your Legal Rights As A Survivor
Survivors of physician sexual abuse may have the right to pursue civil claims against:
- The physician accused of abuse
- Hospitals and healthcare systems
- Medical clinics and physician groups
- Employers or supervising entities
- Institutions that failed to investigate or act on complaints
A civil lawsuit can help survivors:
- Seek accountability
- Expose institutional failures
- Recover compensation for emotional harm and other damages
- Obtain answers through the legal discovery process
- Help protect future patients
Civil claims are separate from criminal proceedings. Survivors may still have legal options even if no criminal charges are filed.
