What Is Considered Child Sexual Abuse in Pennsylvania?
Under Pennsylvania law, child sexual abuse involves any form of sexual activity with a minor, whether or not there is physical contact. Under the law, minors lack the legal capacity to consent to sexual activity. Examples of child sexual abuse include the following:
- Exhibitionism, or exposing oneself to a minor
- Fondling or intercourse
- Masturbation in the presence of a minor or forcing a minor to masturbate
- Obscene phone calls, text messages, or digital interactions
- Producing, owning, or sharing pornographic images of children
- Any sexual conduct harmful to a child’s mental, emotional, or physical welfare
- Sexual trafficking
Pennsylvania law also holds institutions and organizations accountable if they fail to prevent known abuse. For example, if a priest has sexually abused a child, the church could be held accountable for negligently allowing the abuse to occur.
Who Are the Perpetrators?
In many child sexual abuse cases, survivors have been abused by authority figures and trusted individuals. Andreozzi + Foote has represented victims in a variety of diverse situations and experiences, including abuse by:
- Coaches
- Daycare providers
- Teachers
- Religious leaders and volunteers, including priests, clergy, ministers
- Nursing home staff or residents
- Therapists, counselors, physicians, and other professionals
Evidence Needed to Build a Philadelphia Child Sexual Abuse Case
Strong evidence is the key to a successful child sexual abuse lawsuit. At Andreozzi + Foote, our attorneys will investigate your abuse, gathering and preserving key evidence to give you the best possible chance of holding the parties who enabled your abuse accountable. Some sources of evidence commonly used in sexual abuse cases include the following:
- Medical Records: Documentation of injuries or trauma from hospitals or clinics
- Police Reports: Official documentation of the incident filed with law enforcement
- Eyewitness Statements: Testimony from those who may have witnessed the abuse or its aftermath
- Personal Documentation: Diaries, texts, or emails that detail the abuse or communication with the perpetrator
- Expert Testimony: Input from psychologists or counselors who treated the victim
Statute of Limitations for Child Sexual Abuse Cases in Pennsylvania
Under Pennsylvania law, there is now no deadline to file criminal charges for major sex crimes like rape, sexual assault, and trafficking with minors as victims. Prosecutors can file charges at any time. For less severe offenses involving a minor victim, prosecutors have until the victim’s 55th birthday to bring charges.
In Pennsylvania, victims of child sexual abuse now have until their 55th birthday to file a civil lawsuit if the abuse occurred after 2018. That’s because a 2019 law extended the civil statute of limitations. However, the law is not retroactive, and the previous deadline applies to older cases. Therefore, those harmed by child sexual abuse before 2019 have until their 30th birthday to file suit. Regardless of the deadline for your case, acting promptly is crucial to preserving evidence and maintaining your right to seek justice and compensation.
