Key Takeaways

  • Brian P. Daly, a Pennsylvania counselor, faces harassment charges for making sexual comments during an online therapy session.
  • The case raises concerns about the oversight and accountability of online therapy platforms.

Brian P. Daly Investigated

A Pennsylvania counselor who provided therapy through an online platform is facing a harassment charge after authorities say he made sexual comments to a client during a counseling session.

Brian P. Daly, 70, has been charged with a misdemeanor of harassment, which involves communicating lewd, threatening language.

According to the Lower Allen Township Police Department, they were dispatched on September 13th, 2024, “to handle a call about possible harassment. The victim reported that she was seeking counseling through an online company, and they paired her with a counselor named Brian Daly.”

According to a news report on the affidavit, the appointment took place through a platform called Regain, which is owned by the well-known online therapy service, BetterHelp

Investigators contacted BetterHelp and confirmed that Daly had been assigned as the woman’s counselor. Authorities obtained records through a search warrant that verified the phone number used during the session belonged to Daly.

According to the victim, Daly repeatedly brought up sexual topics during the counseling session and continued doing so even after she tried to steer the conversation away. Daly allegedly asked the victim about her sexual history and preferences and asked to see intimate photos of her, as she “sounded sexy.” He also allegedly requested oral sex.

Daly was arrested on February 24, 2026. His next court date is scheduled for March 12, 2026.

Brian P. Daly’s Background

According to Daly’s Facebook profile, he graduated from Temple University in 1979, studied at the California Culinary Academy and graduated in 1985, and then finished his Master’s degree in Counseling Psychology at Temple University in 2008.

On his Facebook, he claims to “help others find and follow their path.”

On his website, Lifespan Processing, where he advertises “mental health maintenance” for all ages, Daly writes, “My personal goal is to promote your psychological health and well-being…. If you are willing to commit to an honest exploration of the negative coding that binds you, I am willing to commit to creating a safe but vibrant environment where exploration becomes an adventure for you.”

He claims to be “born with an overwhelming curiosity about why people behave as they behave,” and says that he lives his “passion of helping those in need of guidance and support as they face their personal truths.”

His LinkedIn profile list his employment history, including:

His Healthline profile lists him as an addiction and substance abuse counselor.

He was also a provider at Center Center City Psychological Services, which offered therapy for children, adolescents, adults, and families.

He also owned the shop More Than Just Ice Cream in Philly from 1990 to 2008.

Licensing Records

State licensing records list Brian P. Daly (License No. PC005544) as a professional counselor, with an expired license.

Records also show Brian Patrick Daly (License No. PS016114) as a licensed psychologist with an active license.

Both licenses are associated with Philadelphia-area addresses, and neither currently reflects disciplinary action.

Abuse of Trust in the Therapeutic Relationship

Sexual abuse or harassment allegations involving a licensed mental health professional can raise serious concerns about patient safety and professional accountability.

Therapy relationships are built on trust, confidentiality, and emotional safety. Many individuals seek counseling while coping with trauma, grief, anxiety, addiction, or other deeply personal challenges. Because of this vulnerability, therapists occupy a position of significant influence, and patients must be able to trust that this authority will not be abused.

Sexualized comments, advances, or requests during a therapy session are not simply “boundary issues.” They represent a serious violation of professional ethics and an exploitation of the power imbalance that exists between therapist and patient.

Online Therapy Platforms, Oversight, and Civil Accountability

The case also raises broader questions about oversight and accountability within online therapy platforms, a sector that has grown rapidly in recent years.

Telehealth counseling services connect patients with therapists through video sessions, phone calls, or messaging systems. While these services can increase access to care, patient safety depends on measures such as provider screening and effective complaint reporting systems.

When harassment or abuse is alleged, civil investigations may examine whether institutions or organizations failed to implement proper safeguards to protect patients, including thorough hiring practices, adequate vetting of providers, and effective monitoring and complaint reporting procedures. Investigations may also consider whether prior complaints existed and how those concerns were addressed.

Civil accountability can help uncover systemic failures while also providing survivors access to resources that support healing.
