Certified Nurse Aide Isiah Favors Charged 

A certified nurse aide, Isiah Favors, is facing felony charges after authorities allege he sexually assaulted a dementia patient.

On July 22, 2026, New York Attorney General Letitia James announced the arrest of Isiah Favors, 38, of Buffalo, a certified nurse aide employed at McAuley Residence, a skilled nursing facility in Erie County. 

Favors has been charged with Rape in the Second Degree and Endangering the Welfare of an Incompetent or Physically Disabled Person in the First Degree.

The Allegations Against Isiah Favors

According to the Attorney General’s Office, the alleged assault occurred at approximately 12:10 a.m. on July 7, 2026.

Court filings allege that Favors engaged in oral sexual contact with the 82 year-old resident, “and due to medical diagnoses, including dementia and other medical conditions, was incapable of consent by reason of being mentally disabled or mentally incapacitated.” 

According to the AG’s office, “A witness immediately reported the incident to the facility’s management, and the victim was transported to the hospital where a rape kit test was conducted. The Tonawanda Police Department reported the matter to OAG.” 

Favors was arrested on July 22, 2026, and arraigned in Tonawanda Town Court. Bail was set at $100,000 cash or a partially secured surety bond. 

In announcing the charges, New York Attorney General Letitia James emphasized the seriousness of the allegations. “My prayers are with the victim and their family who deserve justice after enduring this horrific crime. My office is conducting a full investigation, and we will use every resource at our disposal to deliver justice in this case and ensure all nursing home residents are kept safe.”

Catholic Health Responds to the Allegations

Following the reported incident, Catholic Health, which operates McAuley Residence, provided a statement to WKBW-TV, that said, in part, “‘We immediately removed the accused associate from the facility and alerted law enforcement and the New York State Department of Health.’”

Isiah Favors’ Nurse Aide Certification

According to the New York State Nurse Aide Registry, Favors became a certified nurse aide in September 2023 after completing training at Northgate Health Care Facility and passing the New York State nurse aide competency.

Registry records indicate that his certification is active through September 30, 2027.

As of a registry inquiry conducted on July 27, 2026, the registry listed no resident abuse findings and no criminal convictions.

The registry also lists GreenField Health & Rehabilitation Center as Favors’ last reported employer, with a reported hire date of January 30, 2025.

It is unknown when he was hired at McAuley Residence.

Can a Nursing Home Be Held Legally Responsible?

The criminal proceedings against Isiah Favors will determine whether he is found guilty of the pending charges.

A civil investigation, however, may examine whether McAuley Residence, Catholic Health, or other responsible entities took reasonable steps to protect residents from foreseeable harm.

A civil investigation may examine issues such as:

  • Whether appropriate background checks were conducted;
  • Staff supervision and monitoring;
  • Abuse prevention training;
  • Compliance with mandatory reporting requirements;
  • Whether prior complaints or warning signs existed; and
  • Whether the facility maintained policies and staffing levels designed to protect vulnerable residents.

Whether a nursing home or other institution can be held civilly liable depends on the unique facts and evidence developed during the investigation.
