The age of consent in Michigan is 16 years old, though there are exceptions for consent when a victim is developmentally or physically disabled, unconscious, or unwillingly intoxicated.

What Is The Statute Of Limitations On Sexual Abuse Cases In Michigan?
In Michigan, the deadline for victims to pursue justice for sexual abuse depends on the type of case—civil or criminal.
Michigan has no deadline for filing criminal charges for first-degree criminal sexual conduct. However, second and third-degree cases must be filed within the set deadlines. If the victim was under 18, charges must be filed within 15 years after the incident or by the alleged victim’s twenty-eighth birthday, whichever is later. If the alleged victim was 18 or older, charges must be filed within 10 years of the offense. These deadlines may be extended if DNA evidence is available.
Meanwhile, the civil statutes of limitations depend on the victim’s age and when the harm occurred. In 2018, Michigan passed a law to update the civil statutes of limitations for childhood sexual abuse cases. Under the 2018 law, childhood sexual abuse victims now have until their 28th birthday or three years after they make the connection between the abuse and injury to file a civil lawsuit, whichever is later. However, that law is not retroactive. Minor victims of childhood sexual conduct that occurred before the law’s effective date have 10 years from the incident to file suit, while adult victims of criminal sexual conduct have up to 10 years to file civil lawsuits.
Civil Lawsuit vs. Criminal Prosecution
When seeking justice for sexual abuse, survivors have several options: filing a criminal complaint and filing a civil lawsuit. Criminal cases focus on punishing the assailant through potential jail time or other penalties, while civil claims provide financial compensation for the damages the victim suffered due to the abuse.
- Criminal Prosecution - In a criminal case, the state prosecutes the accused to punish them for breaking the law and to protect society by preventing similar behavior in the future. If the defendant is found guilty, they can be sentenced to serve jail time and pay fines.
- Civil Lawsuit - In a civil lawsuit, the victim files suit against the abuser and those who enabled the abuse to pursue compensation for their losses, including medical bills, lost income, pain and suffering, and emotional distress.
